The U.S. Food and Drug Administration (FDA) has recently classified a previously unclassified food recall involving El Mirasol’s tortillas as Class II, indicating potential health consequences from consuming the affected products. El Mirasol, Inc., headquartered in Plant City, Florida, and one of the largest tortilla manufacturers in the state, initiated a voluntary recall of several batches of its Tortilla de Harina product in late April after suspecting they contained an undeclared allergen—wheat.
This recall affects approximately 50 cases, each containing 20 packages of 10 tortillas. The packages are sold in clear plastic bags, each containing 400 grams of tortillas. The specific batches under recall are identified as lot numbers 012324120800, with an expiration date of February 23, 2024, and 021924120800, with an expiration date of March 19, 2024. These products were distributed solely within Florida.
El Mirasol began recalling the tortillas on April 29, but the FDA only classified the recall on June 17. The FDA categorizes food and soft drink recalls based on the potential health hazards posed by the products. A Class III recall indicates a low-risk product that is unlikely to cause adverse health consequences if consumed. A Class II recall, such as this one, is issued when the use or exposure to the product may cause temporary or medically reversible adverse health consequences, and the probability of serious health consequences is remote. A Class I recall, the most severe, is issued when consumption or exposure to a product can cause serious adverse health consequences or death.
Wheat, an ingredient in these tortillas, can cause significant health reactions in individuals with wheat allergies or celiac disease. A wheat allergy is a common food allergy where the immune system overreacts to the consumption of wheat, causing symptoms such as hives, rash, nausea, stomach cramps, and diarrhea. In severe cases, it can lead to anaphylaxis, a life-threatening condition.
For individuals with celiac disease, the consumption of gluten—found in wheat, barley, or rye—triggers an immune response that damages the lining of the small intestine over time. This damage hinders nutrient absorption and can cause symptoms such as diarrhea, fatigue, weight loss, bloating, nausea, constipation, and anemia. Although there is no cure for celiac disease, it can be managed by adhering to a strict gluten-free diet.
While corn tortillas are naturally gluten-free, flour tortillas, which contain wheat, are not. Therefore, the presence of undeclared wheat in these flour tortillas poses a significant health risk to those with allergies or celiac disease.
Harm and Injuries from Recalled Tortillas
Individuals consuming El Mirasol’s recalled flour tortillas may suffer from various adverse reactions due to the undeclared wheat. People with wheat allergies might experience symptoms ranging from mild hives and stomach discomfort to severe reactions such as anaphylaxis. For those with celiac disease, ingesting gluten can cause serious intestinal damage and long-term health complications if not promptly addressed.
Legal Recourse for Affected Consumers
Victims of adverse reactions due to the consumption of these tortillas have the right to seek compensation for their injuries. Filing a product liability lawsuit involves several critical steps, beginning with gathering evidence of the injury and the product’s involvement. Victims must then establish that the manufacturer failed to disclose the presence of wheat, leading to their adverse health outcomes.
The Lawsuit Process and Legal Assistance
The lawsuit process can be complex and requires the expertise of a skilled attorney. The initial stages involve filing a complaint, discovery (where both parties exchange relevant information), and potentially negotiating a settlement. If a settlement cannot be reached, the case may proceed to trial.
Hiring an attorney is crucial at each step to ensure that the victim’s rights are protected and to navigate the legal complexities of product liability claims. An attorney can help gather evidence, represent the victim in court, and negotiate with the manufacturers or their insurers to secure fair compensation.
Potential Damages in a Product Liability Lawsuit
Victims of this product recall may recover various damages, including medical expenses, lost wages, pain and suffering, and other related costs. In severe cases, punitive damages may also be awarded to penalize the manufacturer for negligence.
