168,000 Units Recalled Across 17 States Due to Undeclared Peanut Risk
Nature’s Path Organic Foods, a well-known brand in the healthy food market, has initiated a recall of over 168,000 frozen breakfast items from their product line. This recall includes 13,615 cases, each containing 12 units, of two popular frozen waffle varieties: pumpkin spice and dark chocolate chip. The recall is due to potential trace amounts of undeclared peanuts, which pose a significant risk to individuals with peanut allergies.
The affected products were distributed across major retailers in 17 states, including California, Colorado, Connecticut, Florida, Georgia, Iowa, Indiana, Maryland, North Carolina, New Hampshire, New York, Ohio, Oregon, Pennsylvania, Texas, Washington, and Wisconsin. Specifically, the pumpkin spice waffles have a best-before date of October 24, 2023, with a lot code of 2C110242 and UPC of 0 5844959077 4. The dark chocolate chip waffles have a best-before date of October 26, 2023, with a lot code of 2C110262 and UPC of 0 5844916701 3. These details can be found on the bottom flap of each box.
Despite no reported illnesses or allergic reactions, Nature’s Path issued the recall as a precautionary measure following a manufacturing error by an external partner. This issue has prompted the U.S. Food and Drug Administration (FDA) to categorize this recall as a Class II recall, which involves products that may cause temporary or medically reversible adverse health effects.
Consumers who have purchased these waffles are advised to return them to the retailer for a full refund. For further inquiries, Nature’s Path consumer services can be contacted at 1-866-880-7284 from Monday to Friday between 8 a.m. and 4:30 p.m. PST, or by emailing ConsumerServices@naturespath.com. No other Nature’s Path products or batches are impacted by this recall.
How People Are Harmed by Undeclared Allergens
The presence of undeclared allergens in food products poses a serious health risk, especially to individuals with severe allergies. Peanut allergies, in particular, are known for causing severe reactions, which can include anaphylaxis—a potentially life-threatening condition that requires immediate medical attention. Symptoms of an allergic reaction to peanuts can range from mild, such as hives and itching, to severe, including difficulty breathing, swelling of the throat, and a sudden drop in blood pressure.
When food products contain undeclared allergens, consumers who rely on ingredient labels to avoid certain foods are put at great risk. Even a small amount of an allergen can trigger a severe reaction. This makes it critical for food manufacturers to adhere to strict labeling practices and ensure their products are free from contamination.
Legal Recourse for Victims of Contaminated Food Products
Victims of allergic reactions due to contaminated food products may be able to file a lawsuit seeking damages. The process generally begins with consulting a personal injury attorney who specializes in product liability cases. These attorneys can help victims understand their rights and guide them through the legal process.
The Lawsuit Process
The first step in filing a lawsuit is to gather evidence that links the injury to the contaminated product. This can include medical records, receipts, and the product itself. The attorney will then file a complaint against the manufacturer, alleging negligence or failure to adhere to safety regulations.
The discovery phase follows, where both parties exchange information and gather evidence. This phase is critical in building a strong case. If the case does not settle during this phase, it may proceed to trial, where a judge or jury will determine liability and damages.
Why Legal Representation is Crucial
Having an attorney is essential at each step of the process to ensure the victim’s rights are protected and to navigate the complexities of product liability law. Attorneys can negotiate with the manufacturer or their insurance company to reach a fair settlement. If necessary, they can represent the victim in court to seek compensation for medical expenses, pain and suffering, lost wages, and other damages.
Potential Damages in Product Liability Lawsuits
Victims can recover various types of damages in a product liability lawsuit. Compensatory damages cover medical expenses, lost income, and other out-of-pocket costs. Non-economic damages may include compensation for pain and suffering, emotional distress, and loss of enjoyment of life. In some cases, punitive damages may be awarded to punish the manufacturer for particularly egregious conduct and to deter similar behavior in the future.
