M&P Food Production Issues Recall Due to Undeclared Allergens in Popular Foods

Brooklyn-Based Company Warns of Potential Severe Allergic Reactions from Blintzes, Pirozhki, and Vareniki

M&P Food Production Ltd., a Brooklyn-based food manufacturer, has issued a voluntary recall for several of its products, including blintzes, pirozhki, and vareniki, after discovering that they may contain undeclared wheat, milk, and sesame. These allergens can pose significant health risks to individuals with allergies or severe sensitivities, potentially leading to life-threatening reactions. The recall affects products distributed across Connecticut, Florida, New York, New Jersey, and Maryland between August 27, 2023, and August 27, 2024, with best-before dates extending through August 2025.

The recall covers a variety of popular Eastern European foods, including:

  • Cheese & Cherry Blintzes (Net Wt. 14 oz.) with UPC: 707163303257
  • Cheese Blintzes (Net Wt. 14 oz.) with UPC: 707163303251
  • Pirozhki with Black Currant, Potatoes, and Cabbage (40 pcs. per box) with no UPC Code
  • Sour Cherry Vareniki (Net Wt. 14 oz.) with UPC: 707163026150
  • Potato & Onion Vareniki (Net Wt. 14 oz.) with UPC: 707163026167
  • Potato & Mushroom Vareniki (Net Wt. 14 oz.) with UPC: 707163026174
  • Farmer Cheese Vareniki (Net Wt. 14 oz.) with UPC: 707163026181

These products were sold in retail stores throughout several states, posing a risk to those with wheat, milk, or sesame allergies. The issue was identified during an inspection by the U.S. Food and Drug Administration (FDA), where it was discovered that the packaging failed to disclose the presence of these allergens.

The Seriousness of Undeclared Allergens

Undeclared allergens in food products can have devastating consequences for those with allergies. Even a small amount of exposure to allergens like wheat, milk, or sesame can trigger severe reactions, including anaphylaxis—a potentially fatal condition that requires immediate medical attention. Other possible reactions include difficulty breathing, swelling of the throat, hives, and digestive issues. The risk is particularly high for individuals who are unaware of the presence of these allergens in the foods they consume.

Given the severity of these potential reactions, it is crucial for food manufacturers to ensure that all ingredients are correctly labeled on their products. The failure to do so not only violates food safety regulations but also endangers the lives of consumers.

Legal Recourse for Injured Consumers

Consumers who have purchased the recalled blintzes, pirozhki, or vareniki and suffered an allergic reaction as a result may be entitled to seek compensation through a product liability lawsuit. Product liability laws hold manufacturers, distributors, and retailers accountable for ensuring the safety of the products they sell. When a company fails to disclose the presence of allergens, they may be held liable for any harm caused.

Victims of such incidents can seek damages for medical expenses, lost wages, pain and suffering, and other related costs. The lawsuit process typically begins with gathering evidence, including medical records, proof of purchase, and any communication with the company regarding the product. It is crucial to consult with an experienced attorney who specializes in product liability to navigate the complexities of the legal system.

Why Legal Representation is Essential

Filing a product liability lawsuit requires a thorough understanding of the law and the ability to prove that the manufacturer was negligent. An attorney can help build a strong case by collecting evidence, negotiating with the company or its insurers, and representing the victim in court if necessary. Without legal representation, victims may struggle to secure fair compensation for their injuries.

Moreover, an attorney can help ensure that all legal deadlines are met and that the case is filed in the appropriate jurisdiction. They can also advise on the best course of action, whether that involves pursuing a settlement or taking the case to trial.

Potential Damages in a Product Liability Case

Victims of allergic reactions caused by undeclared allergens can seek compensation for a variety of damages, including:

  • Medical Expenses: Costs associated with emergency treatment, hospitalization, medication, and ongoing care.
  • Lost Wages: Compensation for time missed from work due to the injury and recovery.
  • Pain and Suffering: Damages for physical pain, emotional distress, and diminished quality of life.
  • Punitive Damages: In cases where the company’s actions are found to be particularly egregious, the court may award punitive damages to deter similar conduct in the future.

Given the potential for significant financial and emotional harm, it is vital that victims pursue all available avenues for compensation.
