Florida Motorcycle Accident Liability

Florida is a no-fault state. Only a rider over the age of 21 who doesn’t wear a helmet is required to purchase Personal Injury Protection insurance.

This insurance will pay for a portion of your medical bills and lost wages. If you have insurance, you must file a claim with your insurance provider. If the injuries you sustained exceed your policy coverage, you can pursue compensation from the negligent party’s insurance provider. If you don’t have insurance, an attorney can help you file a claim with the negligent party.

How Can a Bonita Springs Motorcycle Accident Attorney Help?

At Parker Waichman LLP, our Bonita Springs motorcycle accident attorneys take on several duties when they handle a motorcycle crash case. They are familiar with the laws surrounding motorcycles and know what it takes to build a strong compensation case.

At our law firm, our motorcycle accident lawyers can help in many ways during this difficult time, including:

  • Gathering and analyzing evidence
  • Interviewing witnesses
  • Calculating damages
  • Communicating with the defendant’s insurance provider or attorney
  • Filing a lawsuit on your behalf when an insurance company refuses to make a reasonable settlement offer
  • Representing you in court

Investigating the Cause Of Your Accident

A motorcycle accident lawyer will conduct an in-depth accident investigation to determine the cause of the crash and identify all liable parties. Your attorney may work with an accident reconstruction expert to determine how the accident occurred and who should be held responsible. The legal team at Parker Waichman LLP will also review important documents, including the police report and medical records, motorcycle repair estimates, and interview witnesses, to uncover the truth.

Other evidence they may gather can include:

  • Photos of your injuries, bike damage, and the accident scene
  • Video footage, including dash cam footage, if available
  • Expert witness testimony
  • Phone records

And more.

Motorcycle Accident Lawsuits

Most motorcycle accident cases settle out of court. If the insurance company isn’t willing to make a reasonable settlement offer, your attorney can resolve your case through negotiations. However, some factors may compel a motorcycle accident attorney to pursue compensation in court.

A lawsuit may be filed if:

  • Settlement negotiations have failed and the statute of limitations is almost up
  • The negligent driver’s insurance provider refuses to make a fair settlement offer
At Parker Waichman LLP, a trial-tested Brooklyn motorcycle accident lawyer on our legal team will fight aggressively for you in court, presenting a compelling case that will prove your demand for compensation.

What Types Of Damages Can I Pursue After a Motorcycle Crash?

At Parker Waichman LLP, our motorcycle accident attorneys can help you fight to recover the full settlement or award you deserve.

Compensation can include:

  • Past and future medical care costs
  • Lost wages
  • Loss of future wages
  • Physical therapy costs
  • Rehabilitation
  • Property damage
  • Pain and suffering
  • Emotional distress
  • Loss of consortium
  • Scarring and disfigurement
  • Loss of quality of life

And more.

It’s important to work with an experienced motorcycle accident lawyer to avoid leaving money on the table. Our legal team will carefully calculate your damages to ensure you pursue every penny of compensation you’re entitled to.

Florida Motorcycle Laws Every Rider Should Know

Florida motorcycle laws that every rider must know include:

  • Riders must have a motorcycle endorsement to operate a two or three-wheeled motorcycle.
  • Riders must pass a basic rider course offered by the Motorcycle Safety Foundation to have the endorsement added to their driver’s license.
  • Riders with no driver’s license can obtain a license limited to motorcycle use. This will require the rider to pass the knowledge test and complete the basic rider course. Riders that are under the age of 21 must wear an approved helmet. Motorcyclists over the age of 21 are not required to wear a helmet.
  • All riders are required to wear protective eyewear, such as goggles.
  • Lane splitting is not legal in Florida.
  • No more than two riders are allowed to ride abreast
  • A rider cannot transport a passenger unless the bike is equipped with a passenger seat
  • Riders must always keep their headlights on to make them highly visible to drivers.
  • Motorcycles must be equipped with mirrors.
Obeying Florida’s motorcycle laws can reduce your risk of being involved in a collision. However, motorcyclists are still at risk of being involved in an accident if they’re sharing the road with dangerous, negligent drivers.
