Frequently Asked Questions About Invokana Lawsuits

What is the Problem with Invokana, Invokamet, or Invokamet XR?

The U.S. Food and Drug Administration is requiring the manufacturers of Invokana, Invokamet, and Invokamet XR to place a “Boxed Warning,” their most serious and prominent warning, on these products regarding the increased risk of amputation when type 2 diabetes patients take these drugs.

Two comprehensive studies of canagliflozin have shown that drugs such as Invokana, Invokamet, and Invokamet XR do not work properly and that these medications could exacerbate diabetic complications such as:

  • Kidney Injury
  • Kidney Failure
  • Diabetic Ketoacidosis
  • Toe, foot, or leg amputations

In fact, the U.S. Food and Drug Administration announced that the final results of these two studies “showed that leg and foot amputations occurred about twice as often in patients treated with canagliflozin compared to patients treated with placebo, which is an inactive treatment.”

What Are the Signs and Adverse Side Effects of Invokana, Invokamet, or Invokamet XR?

The U.S. Food and Drug Administration is warning healthcare providers and patients taking Invokana to regularly examine their toes, feet, and legs for any signs of lower limb discoloration, ulcers, sores, pain, tenderness. Patients with any of these side effects or symptoms are advised to immediately contact their prescribing physician to report these side effects and symptoms.

What other SGLT2 inhibitor brand name drugs are on the market?

Currently, the lawsuits connected to SGLT2 inhibitors remain strongly focused on the canagliflozin-based drugs named Invokana, Invokamet, Invokamet XR. These drugs are manufactured and marketed by Janssen Pharmaceuticals and Johnson & Johnson.

However, there are research studies which tie other similar SGLT2 products to several adverse side effects. These other products include:

  • Farxiga (dapagliflozin), manufactured by AstraZeneca
  • Xigduo XR (dapagliflozin and metformin extended release), manufactured by AstraZeneca
  • Jardiance (empagliflozin), manufactured by Boehringer Ingelheim and Eli Lilly
  • Glyxambi (empagliflozin and linagliptin), manufactured by Boehringer Ingelheim and Eli Lilly
  • Synjardy (empagliflozin and metformin), manufactured by Boehringer Ingelheim and Eli Lilly

What is the process for determining if I have a case or not?

Invokana-lawyer

Once we have discussed your potential case and explained all your legal rights, you can decide whether you wish to proceed with the claims process. At that time, you would sign up your case with Parker Waichman LLP.  Once you have retained Parker Waichman LLP, your Invokana lawyer will investigate your claim, determine your eligibility to bring an Invokana lawsuit, and initiate the litigation process to obtain the compensation you are legally entitled.

This process our attorneys follow to properly file your claim:

  • Obtain your Invokana prescription history;
  • Document your injuries while taking Invokana or Invokamet;
  • Obtaining your pharmacy records to prove that you were taking Invokana (which establishes “proof of use”);
  • Ordering medical records that documented medical treatment for the injuries that you sustained because of taking Invokana;
  • Identify the governing statute of limitations pertinent to your Invokana lawsuit;
  • Consult with medical and industry experts;
  • Determining the jurisdiction where your case should be filed (Multidistrict Litigation or elsewhere);
  • Draft and prepare your petition for filing.

What Other Drugs May Be Linked to Amputations of Toes, Feet or Lower Limbs?

On February 24, 2017, the (EMA) or European Medicines Agency released a warning to the public regarding the class of SGLT2 inhibitors. Like the FDA’s “lower limb” amputation warning, the new warning from the EMA also warns about the increased risk of lower leg amputations, but also states the following SGLT2 inhibitors increase the risk for toe amputations.

  • Canagliflozin
  • Dapagliflozin
  • Empagliflozin

How Much Are Your Legal Fees?

At Parker Waichman LLP, there is no legal fee unless we successfully recover financial compensation for you. This is known as a “contingency-fee basis.” A contingency-fee basis means that Parker Waichman LLP will take on all the financial burdens of investigating your claim. We also assume all the cost should we represent you. In other words, Parker Waichman LLP advances the costs of litigating your Invokana claim, and if you do not receive any money because of our legal services, neither do we. Our clients feel better about this approach to legal representation. Also, Parker Waichman LLP performs a very thorough investigation, and we incur a lot of out-of-pocket expenses. If our investigation finds that you do not qualify for filing a claim and we cannot move forward with your claim, you will not receive a bill from us.
