Restwell Mattress Co., a manufacturer based in Eden Prairie, Minnesota, has initiated a significant recall of two types of crib mattresses sold exclusively at Room & Board stores nationwide. These products have been found to fail compliance with the Federal Safety Standard for Crib Mattresses, posing a suffocation hazard to infants.

The recall involves the following Room & Board brand crib mattresses:

  • Natural Organic Latex and Spring Crib Mattress (Model No. 847564)
  • Natural Organic Latex Crib Mattress (Model No. 925869)

The mattresses measure 52 inches long and 28 inches wide, with a white top and gray sides, and the brand name “Room & Board” embroidered on one end. Approximately 100 units have been sold across the United States between August 15, 2022, and June 2023, priced between $350 and $450.

The recalled crib mattresses have been found to be in violation of multiple provisions of the Federal Safety Standard for Crib Mattresses. Specifically, the mattresses do not meet the required firmness test and are missing essential warnings and labels. This non-compliance presents a real risk of suffocation to infants.

Customers who have purchased the recalled crib mattresses should cease using them immediately. Restwell Mattress Co. and Room & Board are actively reaching out to all purchasers and will arrange for a free pickup of the affected products. A full refund will be provided to affected customers.

To initiate the return process or for further inquiries, customers may contact Room & Board toll-free at 800-301-9720 (Monday through Friday, 8 a.m. to 7 p.m. CT; Saturday through Sunday, 10 a.m. to 5 p.m. CT) or by emailing shop@roomandboard.com. Further details on the recall are also available on the Restwell Mattress Recall page found at www.restwellmattress.com/recall and the Room & Board Product Recalls page found at www.roomandboard.com/product-recalls.

The recalled products are manufactured in the United States by Restwell Mattress Co., of Eden Prairie, Minnesota.

The recall is officially recognized under number 23-781. Additional statements from individual Commissioners may be found on the CPSC website at www.cpsc.gov/commissioners.

This recall emphasizes the importance of adhering to federal safety standards and the role of manufacturers and retailers in ensuring that products meet the necessary criteria for child safety. Consumers are strongly urged to respond promptly to this recall notice to protect the well-being of infants using these mattresses.

While no incidents or injuries have been reported at the time of the recall, it is essential to know the steps to take if you or your child have been harmed by these recalled crib mattresses. Preparing for a potential lawsuit requires careful planning and understanding of the legal process. Here’s what you should do if you believe you have a valid claim:

  1. Document the Incident: If harm has occurred, make sure to document all aspects of the incident. Take photos of the mattress, its location, and any injuries. Record specific details, such as dates, times, and the exact circumstances surrounding the incident.
  2. Seek Medical Attention: If there are physical injuries, seek medical attention immediately. Obtain all medical records, bills, and doctor’s reports relating to the injuries.
  3. Preserve the Evidence: Do not discard the mattress or alter it in any way. Keep it in its current condition as it may be crucial evidence in your case.
  4. Contact the Manufacturer and Retailer: Notify both Restwell Mattress Co. and Room & Board about the incident. Follow their instructions regarding the recall but make it clear that you intend to preserve the product as evidence.
  5. Consult with a Personal Injury Attorney: Find an experienced personal injury attorney who specializes in product liability cases. Share all the information, evidence, and documentation with your attorney, who will help assess the strength of your claim.
  6. Gather Purchase Records: Provide evidence of your purchase, such as receipts or credit card statements, to prove ownership of the recalled product.
  7. Compile Witness Statements: If there were witnesses to the incident, gather their contact information and written statements if possible.
  8. Follow Legal Advice: Work closely with your attorney and follow their guidance throughout the legal process. They will likely engage in negotiations with the manufacturer’s legal team and may file a lawsuit if necessary.
  9. Consider Joining a Class Action: If multiple individuals have been harmed by the product, a class-action lawsuit might be filed. Consult with your attorney about the potential benefits or drawbacks of joining such an action.
  10. Maintain Communication: Keep open lines of communication with your attorney and be prepared to provide additional information as needed.
  11. Mental and Emotional Considerations: If the incident has caused mental or emotional distress, consider seeking professional counseling or therapy. Documentation of this treatment might also be relevant to your case.

By following these steps and working with an experienced legal professional, you will be well-prepared to pursue a lawsuit if you or your child have been harmed by the recalled Restwell Mattress Co. crib mattresses. Please remember that laws and procedures can vary by jurisdiction, so local legal expertise is vital.
