U.S. Consumer Product Safety Commission Urges Immediate Discontinuation of 5in1 Rocker Bassinets Due to Severe Risks Including Suffocation, Strangulation, and Falling.

On Sept. 28, 2023, the U.S. Consumer Product Safety Commission (CPSC) has issued an urgent alert, advising consumers to cease the use of 5in1 Rocker Bassinets immediately as they present substantial risks of suffocation, strangulation, and falls for infants.
These bassinets are in violation of the safety provisions outlined by CPSC’s Regulations for Infant Sleep Products. They exhibit non-compliance with the mandated safety norms for bassinets and are deficient in obligatory markings, labels, and guidelines. The absence of a tracking label providing crucial information such as manufacturing date, a mandatory feature for children’s products including durable infant or toddler products, is also noted in the bassinets and their packaging.
Rev Grace Import Inc., the importer located in Pleasant Hill, Missouri, has reportedly not been collaborative with the CPSC regarding the product recall and hasn’t provided any solutions to consumers.
These bassinets, available in green and gray, were retailed online through Walmart.com and other online platforms. They were advertised as a 5in1 Rocker Bassinet on their packaging, which also displayed markings such as “Ya.Ya.Ya, 5IN1UPC Code 09331849600139, 01 Rock Sleeper, 02 Dream Centre, 03 Cozy Seat, 04 Travel Bassinet, 05 Rock & Play, Made in China, and Age 1-36 months.”
The CPSC is emphasizing the immediate cessation of usage of these bassinets and recommends their disassembly and disposal. Although the Regulations for Infant Sleep Products apply to products manufactured post-June 23, 2022, firms are being urged by CPSC to halt the sale of non-compliant infant sleep products, disregarding the manufacturing date. Incidents involving product defects or injuries can be reported to CPSC at www.SaferProducts.gov.
The CPSC also issued the following guidance to parents and caregivers concerning infant sleep:
Infants are safest when sleeping on a firm, flat surface in appropriate sleep environments like cribs, bassinets, or play yards. Utilize only a fitted sheet, avoiding the addition of blankets, pillows, padded crib bumpers, or any other items in an infant’s sleeping area. Infants must be laid to sleep on their back and those who fall asleep in an upright or inclined position should be transferred to a secure sleep setting with a firm, flat surface like a crib, bassinet, or play yard.
Statements related to this topic by Individual Commissioners may be available at www.cpsc.gov/commissioners.
How to Begin the Claims Process
Families whose children suffered due to the use of the hazardous 5in1 Rocker Bassinets might be entitled to pursue a product liability lawsuit to seek compensation for damages incurred. When a product fails to function safely as intended and causes harm, the manufacturer, distributor, or retailer may be held liable. In this case, the victims can allege that the bassinets had manufacturing defects, design flaws, and lacked appropriate warnings and instructions, making them unreasonably dangerous for infant use.
Potential plaintiffs in such a lawsuit could include parents or guardians of infants who have experienced harm or distress due to the aforementioned bassinets. The damages they may be able to recover could encompass various categories such as medical expenses incurred for treating any injuries or health complications arising from the use of these bassinets, pain and suffering experienced by the infant and the family, and perhaps even punitive damages, aimed at penalizing the responsible parties for their negligence or misconduct.
Furthermore, damages may also include compensation for emotional distress suffered by the family, especially if the infant experienced severe harm or life-threatening situations. If, unfortunately, any fatalities occurred due to the product, the families of the deceased could pursue wrongful death claims to seek damages for funeral expenses, loss of companionship, and more.
When pursuing a product liability lawsuit, it is essential for victims and their families to seek experienced legal counsel who specialize in product liability and personal injury law. A skilled attorney can help navigate the complexities of the legal system, ensure the proper filing of the lawsuit, and advocate for the maximum compensation possible for the victims and their families.
