T.W. Garner Food Company has decided to voluntarily recall 50,688 12 oz. bottles of Texas Pete® Buffalo Wing Sauce, with the best-use-by date of 120623T 065239 and UPC 0 75500 10011 6. This is due to a potential mix-up in which some bottles may instead contain Texas Pete® Extra Mild Wing Sauce, which includes soy. Individuals with soy allergies or severe sensitivities are at risk of experiencing serious or potentially fatal allergic reactions if they consume this product.

The affected product can be recognized as a 12 oz. glass bottle filled with orange sauce, labeled as Texas Pete® Buffalo Wing Sauce. The specific product involved has a best-used-by date of 120623T 065239 printed on the cap.

As of now, there have been no reports of illnesses related to this issue.

The decision to initiate the recall came after a direct customer found a bottle labeled as Texas Pete® Buffalo Wing Sauce, but it contained Texas Pete® Extra Mild Wing Sauce. The Buffalo Wing Sauce bottle did not declare the presence of soy. Investigations revealed that the mislabeling occurred due to an error during part of the production run.

The product has been distributed to centers and retail stores across AL, CT, FL, GA, LA, MS, NC, NY, PA, SC, TN, TX & VA. We strongly urge consumers with soy allergies or sensitivities who have purchased Texas Pete® Buffalo Wing Sauce with the best-use-by date of 120623T 065239 and UPC 0 75500 10011 6, to not consume the product. Instead, they should either discard it or return it to the point of purchase for a full refund.

Understanding Soy Allergy

A soy allergy is a prevalent type of food allergy, particularly amongst babies and children. It is usually outgrown by the time the child reaches the age of three. The reactions to a soy allergy can range from mild to severe and may include:

  • Anaphylaxis
  • Skin reactions such as hives, itching, or eczema.
  • A tingling feeling in the mouth.
  • Swelling in parts of the body, including the lips, face, tongue, and/or throat.
  • Respiratory issues like wheezing, a runny nose, or difficulty breathing.
  • Gastrointestinal discomfort, including abdominal pain, diarrhea, nausea, or vomiting.
  • Feeling of dizziness, lightheadedness, or fainting.
  • Death.

In some cases, individuals may experience a severe allergic reaction to soy known as anaphylaxis, which can be life-threatening if not promptly addressed. It’s essential to consult your healthcare provider about potential symptoms and treatment plans. In emergency situations where breathing becomes difficult, immediately call 911.

Qualifying to File a Product Liability Lawsuit

Product liability pertains to the legal responsibility of a manufacturer or vendor for selling a defective product. When a product recall occurs, as in the case of the Texas Pete® Buffalo Wing Sauce, certain prerequisites must be met to qualify for filing a product liability lawsuit.

Initially, evidence of harm or injury is essential. A product liability lawsuit can only be filed if you or a loved one have been physically harmed or experienced severe allergic reactions, such as those that can result from an undeclared soy allergen. Financial losses, such as medical bills or loss of income due to illness, also qualify as harm.

Secondly, it must be established that the harm was directly caused by the product defect – in this case, the undeclared presence of soy in the Buffalo Wing Sauce.

Moreover, the product must have been used as the manufacturer intended. For a product liability claim, you must have consumed the product in a way that could be reasonably anticipated by the manufacturer.

Additionally, the product should not have been significantly altered from its original condition. Any modification that affects the performance of the product and contributes to the injury may influence the eligibility to file a product liability lawsuit.

Finally, preserving the product is crucial to your product injury or wrongful death case. The defective product serves as a key piece of evidence in your lawsuit. Your product liability attorney will need to examine it to strengthen your case effectively.

If you or a loved one suffered an allergic reaction or other harm due to the undeclared soy in the Texas Pete® Buffalo Wing Sauce, you might be eligible to file a product liability lawsuit.
