According to MagnoliaStateLive.com, the U.S. Consumer Product Safety Commission (CPSC) has issued a safety warning to the public concerning TureClos bicycle helmets sold at Walmart. The CPSC stated that these bicycle helmets do not meet federal safety standards and can fail to protect bicyclists in the event of a bike accident resulting in head and brain injuries. The CPSC’s warning states that the defective TureClos bicycle helmets also fail to comply with federal regulations concerning positional stability, impact attenuation, retention system, and certain labeling requirements that are required on bicycle helmets.
The Chinese seller, Dongguanshisuyubgsgabgnaiyiuxiangongsi, is refusing to recall the dangerous bicycle helmets or provide a remedy to purchasers. The CPSC stated that the agency would continue to pursue a recall. In the U.S., companies with dangerous products have the option to initiate a voluntary recall to show good faith. However, if a company refuses to issue a safety recall concerning a product deemed unsafe by the CPSC or the FDA, these agencies could force a recall. The process of forcing a recall can vary widely depending on the specific circumstances of the case. In general, the CPSC will move as quickly as possible to address any safety issues related to a product, but the process can be complex and may take several months or longer.
The CPSC typically begins its investigation after receiving reports of a product defect or safety hazard. The agency will conduct an investigation to determine the extent of the problem and whether a recall is necessary. If a recall is deemed necessary, the CPSC will work with the manufacturer or importer to develop a recall plan, which will include details on how the product will be recalled, how consumers will be notified, and how the product will be repaired or replaced.
The length of time it takes for the CPSC to force a recall can depend on a variety of factors, including the complexity of the investigation, the severity of the safety issue, and the cooperation of the manufacturer or importer. In some cases, the CPSC may issue a voluntary recall request to the manufacturer, and the recall may be initiated quickly. In other cases, the CPSC may need to go through a lengthy legal process to force the recall.
The Chinese TureClos bicycle helmets were sold online at walmart.com from March 2022 until the end of November 2022 at a price of $13. The bicycle helmets were sold in size Large and are designed to fit a head circumference of approximately 22 ½ to 25 inches. The affected bicycle helmets are black in color with blue accents, black and white stripes, or black straps with a red buckle. There are no outer markings and no inside labels.
The CPSC stated that it tested the TureClos bicycle helmets and ascertained the helmets do not meet U.S. federal safety standards for bicycle helmets. The CPSC is urging consumers to immediately stop using the affected bike helmets, cut the chin straps, and then throw the helmets away.
