Hematopoietic and Unspecified Lymphoid

On September 11, 2001, thousands of Americans were killed as the country came under attack by terrorists. However, since that date, many more have died or have been diagnosed with severe, debilitating illnesses, such as cancers and other chronic diseases. Sadly, thousands of these individuals are unaware that they are even eligible for compensation, thanks to a bill that President Barack Obama signed in 2015.

President Obama signed a bill that reauthorized the James Zadroga Health and Compensation Act of 2010. The bill also reauthorized the September 11 Victim Compensation Act.

According to these bills, those who have been diagnosed with certain conditions may be eligible for compensation.

Claimants must show that they worked or volunteered at the attack sites, or that they worked, lived, attended school, volunteered, or otherwise spent time in the New York City exposure zone. The New York City exposure zone covers the area of Manhattan south of Canal Street, from the Hudson River in the west to Clinton Street in the east. Various types of documentation may be accepted to prove that a claimant was in these areas. Claimants must show that they were in the New York City exposure zone from the date of the attacks until May 30, 2002.

Claimants must also show that they have been diagnosed with an illness or condition that is eligible for compensation under the funds. Other and unspecified lymphoid, hematopoietic, and related tissue conditions may be eligible for compensation.

These conditions may include:

  • Malignant mast cell tumors
  • True histiocytic lymphoma
  • Malignant histiocytes
  • Letterer-Siwe disease
  • Other related conditions not otherwise specified

These conditions are often deadly. If you have been diagnosed with one of these conditions and were exposed to toxic debris after the September 11 attacks, you should consult with an attorney as soon as possible to learn about your legal options and if you are eligible for benefits under these funds.

How long do I have to file a claim?

If you are eligible for benefits under the funds, you have until December 18, 2020, to file a claim seeking compensation. This appears to be plenty of time, but many claimants become frustrated when they realize how long it can take to compile all of the documentation that is needed in these claims. For example, gathering medical records can be a lengthy process, and requesting employment records may also take several weeks. Therefore, the sooner you start working on your claim, the better.

What damages may I be entitled to under the fund?

With the assistance of your attorney, you will be able to pursue all available benefits. However, you should seek legal help as soon as possible to ensure your claim is processed in a timely manner. If you miss this important deadline, you could be responsible for all of your expenses.

The law firm worked with me on a victim compensation fund. Christina Morace was the paralegal and through the long process she called me to keep me up to date. She let me know what paperwork was coming and what it meant. She also called to explain the time table for each part. I did not have to wonder about what was happening. I really appreciate her work and the others at Parker Waichman.
