Poor road design is responsible for 1,000s of serious motor vehicle accidents throughout the United States. These accidents are particularly more dangerous because these crashes often occur while the vehicle is traveling at high rates of speed. Moreover, these accidents end with the vehicle crashing into trees leading to fatal or life-threatening injuries.
Although accidents caused by poor road design are catastrophic, many local and state governments fail to correct the dangerous road or do not adequately warn drivers of the dangers ahead. Other governments have engaged organizations such as Vision Zero to identify dangerous roadways and devise plans to correct the hazardous section of the road. Zero Vision was founded in Sweden and has been implemented in cities throughout the United States.
Common Road Defects That Cause Severe Car Accidents
City and state governments have a duty to make sure that the roads they are responsible for are adequately inspected, maintained, and repaired. Thousands of bridges, streets, highways, and interstates can become serious hazards for motorists when roadways are designed and constructed with dangerous defects. The most common road defects that cause severe motor vehicle accidents include:
- Missing or defective guardrails;
- Dangerous pavement drop-offs;
- Unsuitable road curve banking;
- Failing to install needed traffic signs or signals;
- Insufficient lighting;
- Vegetation overgrowth;
- Unrepaired potholes and irregular pavement;
- Deficient drainage;
- Potholes;
- Improper surfacing;
- Lack of signage at intersections;
- Failure to warn of a dangerous condition;
- Loose asphalt;
- Dangerous medians;
- Insufficient warning signs;
- Standing water on the roadway; and
- Lack of reflective markers or road lines.
If your or your family member’s crash was caused by one or more of the aforementioned causes of accidents, you or your loved one might be able to file a lawsuit against the responsible government agency demanding damages. These types of lawsuits will hold the at-fault government agency responsible for designing, constructing, or failing to fix a hazardous road condition.
Recovering Damages After Harmed in an Accident Caused by Dangerous Road Construction
Government agencies that negligently fail to repair or maintain roads can and should be held liable for the accidents that these dangers cause. These motor vehicle accident cases are different than auto accident claims against negligent drivers because roadways are typically built and maintained by government agencies who made be protected by sovereign immunity laws. However, it may be possible to proceed with a lawsuit against a government agency when they act with gross negligence.
It is crucial to understand is that time you have to file a lawsuit against a government is much shorter than other types of legal actions. There might be additional facts that you must prove to win against a municipality. Because these types of claims are very complicated, it is important that you speak with and retain a law firm that has experience handling these types of cases.
Parker Waichman LLP Files a Head-on Car Collision Lawsuit Alleging Failure to Timely Install Traffic-calming Devices
Parker Waichman LLP attorneys Jerrold S. Parker, and Brett A. Zekowski, filed a lawsuit on behalf of the sole survivor of a tragic Uber accident that took the life of her boyfriend, friend, and brothers. The victim’s Uber was hit head-on by a vehicle along the Montauk Highway in Quogue, New York. The Uber driver and the other motor vehicle driver also tragically passed away in a head-on accident.
Our firm’s complaint alleges that our client’s crippling injuries were caused by the negligent, careless, reckless, and gross negligence of the Incorporated Village of Quogue, the Quogue Police Department, Police officer Gennaro Descalo, the County of Suffolk in designing, creating, owning, operating, controlling and/or maintaining the dangerous roadway; failing to properly install traffic-calming devices, technology and/or measures for both west and eastbound traffic that would have controlled the speed of motor vehicles at and before the known dangerous curve. The lawsuit also alleges that Police officer Gennaro Descalo and the Village of Quogue acted recklessly and disregarded the safety of the public by engaging in a high-speed police chase of the vehicle that collided head-on into the victim’s vehicle in the road where there is a known, very dangerous, very sharp curve. Our firm is seeking damages on behalf of the victim. Our attorneys are seeking monetary compensation for our client’s severe injuries, loss of quality of life, medical expenses, loss of income, pain and suffering, and other damages.
According to our firm’s founding attorney, Jerrold S. Parker, “Based on our experience in litigating thousands of automobile accidents in New York, we know that roads must be designed and maintained, to deal with real-life situations and police officers have a duty to act responsibly and not with a reckless disregard for the safety of the public. Our investigation has revealed that this was not the case as to the roadway and the police actions.”
Parker Waichman LLP Attorney Brett A. Zekowski added, “not only were the drivers of the vehicles to blame for her injuries but so was the roadway itself.” That investigation, Zekowski said, is ongoing.
