PARKER WAICHMAN LLP – NEUROBLATE PROBE LAWSUITS
The Defective Medical Device Lawyers of Parker Waichman LLP are currently evaluating potential Monteris Medical NeuroBlate Probe lawsuits. The NeuroBlate Probe has been linked to one serious death and may have caused injuries to many other patients. If you have sustained injuries related to the NeuroBlate Probe, you may be entitled to compensation.
Monteris Medical NeuroBlate Probe Injuries
The Monteris Medical NeuroBlate Probe is a component of the NeuroBlate System, a laser thermotherapy medical device used in procedures involving soft tissue of the brain. Monteris Medical launched the NeuroBlate System in 2013, and the device has been used in thousands of medical procedures across the country. While the device is intended to assist in medically necessary and complicated procedures, reports of injuries and one death demonstrate that the device certainly is not functioning as intended.
When medical devices cause or contribute to causing a person’s injuries or death, the manufacturer of the medical device may be held accountable if it knew or should have known that its medical device may cause a patient to sustain injuries or death. If Monteris Medical did know about the potential for injuries or death and did not adequately warn health care providers, then patients affected by the NeuroBlate System may be entitled to compensation.
Patient Suffers Fatal Intracranial Hemorrhage After Procedure Involving Use of the NeuroBlate System
Reports indicate that the NeuroBlate probe is overheating, a problem that may be caused by an interaction with the probe and the use of MRIs. Overheating of the NeuroBlate probe has the potential to cause damage to surrounding brain tissue. One patient who was undergoing a procedure with the use of the NeuroBlate System suffered a fatal intracranial hemorrhage. The current position from the Food and Drug Administration (FDA) is that a clear link between the use of the NeuroBlate System and the patient’s death is not conclusive. However, the adverse event was serious enough to warrant further investigation and pull the NeuroBlate System from the market.
FDA Issues Class I Recall of Monteris Medical NeuroBlate Probe
Between October and December of 2017, Monteris Medical released three advisories regarding the NeuroBlate System to provide information to health care providers to help minimize the risk of overheating, and therefore, minimize the risk of injury or death. However, the FDA concluded that the information provided by Monteris Medical was not sufficient enough to minimize the risk of injury or death. Monteris Medical ultimately recalled the NeuroBlate System voluntarily, and the FDA subsequently issued a Class I recall. Such a recall indicates that a medical device may cause serious injuries or death.
The FDA strongly urges health care providers to find alternative treatment methods to help patients who need to undergo neurosurgery, and specifically, laser thermotherapy. However, the FDA did state that if the NeuroBlate System was the only viable option for performing a neurosurgical procedure.
Did Monteris Medical Know About the Dangers Associated with the NeuroBlate Probe?
It is unclear how long the FDA has been receiving reports of overheating of the NeuroBlate Probe, and how many people have suffered injuries because of such overheating. Because the FDA found that Monteris Medical did not provide sufficient information to health care providers in its product advisories issued between October and December of 2017, many patients are wondering if Monteris Medical did enough to prevent unnecessary injuries or deaths. The patient who suffered a fatal intracranial hemorrhage may not have been sufficiently warned about the risk of the probe overheating and consequential damage to brain tissue. If Monteris Medical knew about the overheating and provided sufficient information to health care providers, this innocent patient may not have suffered such a terrible fate.
Find Out if You Have a Potential Monteris Medical NeuroBlate Probe Lawsuit
When evaluating a potential product liability claim involving a defective medical device, the Defective Medical Device Lawyers of Parker Waichman LLP will look at a set of criteria to determine if a client has a potential legal claim. The following factors will help a lawyer decide whether to pursue legal action on behalf of an injured or deceased individual:
- Whether the patient underwent a neurosurgical procedure where the NeuroBlate Probe was used;
- Whether the NeuroBlate Probe overheated during the neurosurgical procedure;
- Whether the patient suffered injuries, including damage to surrounding brain tissue, or death (like the patient who suffered an intracranial hemorrhage, for example);
- Whether a physician has diagnosed the patient with a soft tissue brain injury or bleed;
- Whether the patient has required substantial medical treatment because of the injury; and
- Whether the statute of limitations period for pursuing a lawsuit has expired.
It can be difficult to know whether a potential legal claim will be successful in court until a NeuroBlate Probe Lawsuit Lawyer moves forward with reviewing a client’s medical records and goes through the discovery process where documents and testimony are obtained from Monteris Medical, the manufacturer of the NeuroBlate System. Potential clients should always keep in mind that every case is different, and it is simply not possible to guarantee results. However, at Parker Waichman LLP, we work diligently to help clients have the best chance possible of receiving compensation for their injuries or the death of a loved one.
