Baby Formula Recalled from CVS and H-E-B Stores Due to Excess Vitamin D Levels
A recent recall has affected infant formula sold by major retailers CVS and H-E-B, following concerns over Vitamin D levels exceeding the maximum allowable limits. Perrigo Company, the manufacturer of H-E-B Premium Infant Formula with Iron Milk-Based Powder and CVS Health Premium Infant Formula with Iron Milk-Based Powder, has voluntarily recalled approximately 16,500 cans of the formula. This recall impacts consumers in several states, including Florida, Texas, California, Missouri, and more.
The recall affects specific lots of H-E-B Premium Infant Formula with Iron Milk-Based Powder and CVS Health Premium Infant Formula with Iron Milk-Based Powder. The H-E-B formula, distributed to Texas stores, includes lot numbers T11LMXC and T09LMXC, with use-by dates of November 11, 2025, and November 9, 2025, respectively. The CVS Health formula, which was distributed across 12 states, including Florida, New Jersey, and Michigan, is linked to lot number T11MYC with a use-by date of November 11, 2025.
The concern centers around Vitamin D levels in the formula that exceed the maximum levels permitted by regulations. While the manufacturer, Perrigo, has indicated that most infants consuming the affected formula are unlikely to experience adverse health effects, there is a risk for a subset of infants, particularly those with impaired renal function. For these vulnerable infants, the excessive Vitamin D levels could lead to complications, potentially impacting their health.
Risks Associated with Excess Vitamin D in Infants
Vitamin D is essential for healthy bone development in infants, but too much of it can lead to hypercalcemia—a condition characterized by an excess of calcium in the blood. Symptoms of hypercalcemia in infants may include nausea, vomiting, weakness, and in severe cases, kidney damage. Infants with underlying health issues, particularly those related to kidney function, are at higher risk of developing serious complications from excess Vitamin D intake.
Parents and caregivers are urged to be vigilant for any signs of these symptoms, particularly if their child has consumed formula from the recalled lots. It’s important to consult a healthcare professional immediately if any health concerns arise, and to discontinue use of the affected formula.
Legal Recourse for Affected Families
If a child has suffered harm due to consuming the recalled infant formula, parents may have grounds to pursue a product liability lawsuit against the manufacturer, Perrigo Company. Product liability laws are designed to hold manufacturers accountable when their products cause harm, especially when those products are intended for vulnerable populations like infants.
In a product liability lawsuit, the plaintiff (in this case, the child’s family) must prove that the product was defective and that this defect directly caused the injury. The types of damages that may be recoverable include medical expenses, pain and suffering, and in some cases, punitive damages intended to penalize the manufacturer for their negligence.
The Importance of Legal Representation
Navigating a product liability lawsuit can be complex, particularly when it involves the health and well-being of a child. An experienced attorney can provide invaluable support, guiding families through the legal process and helping them build a strong case. Legal professionals are equipped to handle the intricacies of these cases, from gathering evidence to negotiating settlements or taking the case to trial if necessary.
Having a knowledgeable attorney on your side ensures that your family’s rights are protected and increases the likelihood of receiving fair compensation for the harm caused.
