CPSC Urges Caution While Celebrating as Fireworks-Related Injuries Trend Upward

Rising Injuries Highlight the Need for Fireworks Safety and Legal Remedies for Victims

As the Fourth of July approaches, Americans nationwide are preparing to celebrate with family, friends, and fireworks. However, a new report from the U.S. Consumer Product Safety Commission (CPSC) underscores the hazards posed by consumer fireworks use. In light of the increasing trend of fireworks-related injuries and deaths, the CPSC is urging the public to exercise caution and follow safety guidelines to prevent tragic incidents.

In 2023, the CPSC received reports of eight deaths and an estimated 9,700 injuries involving fireworks. Among these fatalities, five were due to misuse, two resulted from device malfunctions, and one involved unknown circumstances. Despite a recent decline in injuries since the pandemic peak in 2020, the overall trend from 2008 to 2023 shows a worrying increase in fireworks-related injuries.

CPSC Chair Alex Hoehn-Saric emphasized the importance of safety during fireworks celebrations, reminding consumers that even sparklers, often considered safe, can pose significant dangers. Sparklers burn at temperatures of about 2,000 degrees Fahrenheit, hot enough to melt some metals. Hoehn-Saric advises purchasing legal fireworks intended for consumer use from reputable retailers and following the CPSC’s safety tips.

Fireworks-Related Injuries: A Closer Look

The CPSC conducted an analysis of injury data during the four weeks surrounding the Fourth of July in 2023. The findings revealed that teenagers aged 15 to 19 had the highest estimated rate of emergency department-treated fireworks-related injuries, followed by children aged 5 to 9. Firecrackers and sparklers were the primary culprits, causing an estimated 800 and 700 injuries, respectively.

The parts of the body most frequently injured by fireworks include hands and fingers (35% of injuries) and the head, face, and ears (22%). Burns accounted for about 42% of emergency department-treated fireworks-related injuries. Additionally, in fiscal year 2023, approximately 18% of selected and tested fireworks products were found to contain noncompliant components, including fuse violations, prohibited chemicals, and pyrotechnic materials overload.

Preventing Fireworks Injuries: CPSC Safety Tips

The CPSC urges consumers to celebrate safely by adhering to the following guidelines:

  1. Never allow children to play with or ignite fireworks, including sparklers.
  2. Ensure fireworks are legal in your area and only purchase fireworks labeled for consumer use.
  3. Never use fireworks while impaired by alcohol or drugs.
  4. Keep a bucket of water or a garden hose handy for emergencies.
  5. Light fireworks one at a time and move back quickly.
  6. Do not attempt to relight or handle malfunctioning fireworks; soak them with water and dispose of them.
  7. Never place any part of your body directly over a fireworks device when lighting the fuse.
  8. Avoid pointing or throwing fireworks at anyone.
  9. After fireworks have burned out, douse them with water to prevent trash fires.

The Impact of Fireworks-Related Injuries and Legal Recourse

Fireworks-related injuries can have severe and lasting impacts on victims. Common injuries include burns, lacerations, fractures, and eye injuries, which can lead to permanent disability or disfigurement. Victims often face significant medical expenses, lost wages, and emotional trauma. These injuries are not only physically debilitating but also financially and emotionally draining.

Victims of fireworks-related injuries caused by defective products or misuse may have the right to seek compensation through a product liability lawsuit. Filing a lawsuit involves proving that the injury was directly caused by a defective or mislabeled product. Gathering evidence such as medical records, witness statements, and the defective product itself is crucial in building a strong case.

The legal process begins with a consultation with a personal injury attorney. The attorney will assess the case, gather necessary evidence, and advise the victim on the best course of action. Once a lawsuit is filed, the discovery phase allows both parties to exchange information and evidence. Settlement negotiations may take place, but if a fair settlement cannot be reached, the case may go to trial.

Having an experienced attorney is vital in navigating the complexities of product liability lawsuits. An attorney can help ensure that the victim’s rights are protected, negotiate with insurers, and represent the victim in court. Legal representation is crucial in securing compensation for medical expenses, lost wages, pain and suffering, and other related damages.
