CPSC Warns Consumers That Mega-Tac Permanent Adhesive Poses Poisoning Risk to Children

The U.S. Consumer Product Safety Commission (CPSC) has issued a critical warning regarding the use of Mega-Tac Permanent Adhesive, Silicon Liquid Glue. Consumers are urged to immediately stop using this product due to its failure to meet child-resistant packaging requirements under the Poison Prevention Packaging Act (PPPA). The liquid glue, which contains a significant concentration of methanol, poses a severe poisoning risk to young children if ingested.

Safety Concerns and Immediate Actions

Mega-Tac Permanent Adhesive, manufactured in Taiwan and imported by Genesis Inc. of Puerto Rico, is available in 3.38 oz (100 ml) translucent white plastic bottles with blue, pointy caps. The product was sold in various craft, gift, clothing, and office supplies stores in Puerto Rico, including Detalles Impresos, Capri Guaynabo, and Mundo Lápiz, from August 2019 through June 2021. The packaging’s non-compliance with the PPPA’s child-resistant requirements, coupled with the violation of the Federal Hazardous Substances Act (FHSA) due to improper labeling, significantly elevates the risk of accidental poisoning among children.

The CPSC’s urgent warning follows the issuance of a Notice of Violation to Genesis Inc., which has yet to agree to a recall or provide a remedy for consumers. Given the product’s potential danger, it is imperative for consumers to stop using the glue immediately and dispose of it following local disposal regulations.

Understanding the Risks and Legal Recourse for Victims

The presence of methanol, a highly toxic substance, in Mega-Tac Permanent Adhesive creates a serious health hazard. Methanol ingestion can lead to symptoms such as headaches, dizziness, nausea, vomiting, and in severe cases, blindness or death. Young children, who may be attracted to the adhesive’s appearance, are particularly vulnerable to these risks.

Victims harmed by this hazardous product may pursue legal action through a product liability lawsuit. This legal recourse aims to secure compensation for injuries and damages caused by the product’s defects and the manufacturer’s negligence. The lawsuit process begins with consulting a qualified attorney who specializes in product liability cases. An attorney will evaluate the case’s merits, gather necessary evidence, and navigate the complex legal landscape to build a strong case.

Filing a Lawsuit and the Importance of Legal Representation

The legal process for product liability claims involves several critical steps, each requiring meticulous attention to detail. Initially, the attorney will gather evidence, including medical records, incident reports, and expert testimonies, to establish the product’s defect and the manufacturer’s liability. The attorney will then draft and file the lawsuit, ensuring compliance with all procedural requirements and deadlines.

Negotiating with the defendant or their insurance company is another crucial phase, where the attorney advocates for a fair settlement. If a settlement cannot be reached, the case proceeds to trial, where the attorney presents the evidence and argues on behalf of the victim to secure a favorable judgment.

Having an experienced attorney is essential for navigating the legal process efficiently and effectively. An attorney’s expertise ensures that the victim’s rights are protected and maximizes the chances of obtaining a fair and just compensation.

Potential Damages in Product Liability Lawsuits

Victims of product-related injuries can seek various types of compensation through a product liability lawsuit. Compensatory damages cover medical expenses, lost wages, and pain and suffering. Additionally, punitive damages may be awarded in cases where the manufacturer’s conduct was particularly reckless or egregious, serving as a deterrent against future negligence.

Emotional distress and loss of consortium are other potential areas of compensation, particularly if the injury affects the victim’s familial relationships. Securing these damages not only provides financial relief to the victims but also holds manufacturers accountable for their actions, promoting higher safety standards in the industry.
