CPSC Issues Urgent Warning Against the Use of Boppy and Momaid Infant Loungers

The Consumer Product Safety Commission (CPSC) warns against using certain baby loungers due to suffocation risks. The Boppy Company and CPSC recalled Boppy Newborn Loungers in 2021 after suffocation incidents, including two infant deaths. Despite the recall, these loungers are still sold online. The Momaid infant lounger also poses risks and lacks safety labels. Consumers are advised to stop using these products and dispose of them. Legal action can be pursued if harm occurs, with guidance available from Parker Waichman LLP for affected families seeking compensation.

Suffocation Risks Prompts Warning About Popular Baby Loungers

The Consumer Product Safety Commission (CPSC) is urgently alerting the public about the potential risks associated with two brands of newborn and infant loungers.

In the initial case, both the CPSC and The Boppy Company, based in Golden, Colorado, have advised consumers to cease usage of the recalled Boppy Original Newborn Loungers, Boppy Preferred Newborn Loungers, and Pottery Barn Kids Boppy Newborn Loungers.

In September 2021, three million Newborn Loungers were taken off the market due to a suffocation hazard when infants roll, move, or are positioned on the lounger in a way that impedes their breathing, or roll off the lounger onto a separate object like an adult pillow.

Not long after the recall, two infants tragically passed away in Newborn Loungers which were part of an unsafe sleeping arrangement. One of these fatalities happened in October 2021.

Selling the Newborn Loungers has been prohibited since the recall. However, since that time, both CPSC and Boppy have repeatedly contacted Facebook Marketplace and other online vendors to remove these recalled items which persist in being listed for sale on their platforms.

The Boppy Company can be contacted by consumers for guidance on proper product disposal and refund information. They can be reached at (800) 416-1355 from 9 a.m. to 5 p.m. (ET) Monday through Friday, or online at https://www.boppy.com/pages/product-recalls for further details.

Momaid Infant Lounger

The second item causing concern is the Momaid infant lounger. It does not meet federal safety standards for infant sleep products and thus presents a suffocation and fall risk to infants.

Moreover, the lounger and its packaging are missing a tracking label that should contain specific required data, including the manufacturing date.

While the CPSC has issued a recall for this product, it has noted that the seller, Zhejiang Juster Trading of China, is not assisting or offering a resolution to customers.

The loungers, marketed as Baby Lounger Portable Infant Co Sleeping Bassinet Newborn Cocoon Snuggle Reversible Nest Bed Travel Crib, were sold with a pillow and in four different fabric prints: Banana Gray Leaf, Blue Palm Leaf, Mint Lychee Leaf, and Pink Lychee Leaf. They were sold on Amazon and other websites for approximately $55.

The CPSC is advising consumers to stop using the loungers, cut the fabric, and promptly dispose of the fabric and pillow.

The CPSC continues to stress that the safest place for an infant to sleep is on a firm, flat surface in a crib, bassinet, or play yard.

Parents and caregivers are strongly advised against adding blankets, pillows, padded crib bumpers, or any other items to an infant’s sleep setting. Physicians recommend that babies should always be put to sleep on their backs.

How to Get Legal Justice if Your Baby Was Harmed By This Product

If your baby was harmed by these recalled infant loungers, seeking legal justice can provide a measure of closure and help offset medical costs and other damages. Here are the steps you can take:

  1. Collect Evidence: The first step in pursuing legal action is to gather and document all evidence related to the harm caused by the product. This includes medical reports, pictures of injuries, and documentation of the product in question, such as receipts and any communication with the manufacturer or seller.
  2. Report the Incident: Notify the Consumer Product Safety Commission (CPSC) about the incident. Filing a report with them can assist their ongoing investigation and help alert other parents to the potential risks.
  3. Consult with a Lawyer: Reach out to a lawyer who specializes in product liability cases. They can guide you through the process, help determine the strength of your case, and advise on potential compensation. Your lawyer will assess whether negligence on the part of the manufacturer or seller can be proven, which is key in a product liability lawsuit.
  4. File a Lawsuit: If your lawyer deems it viable, they will help you file a lawsuit against the manufacturer, seller, or any other party deemed responsible for the harm caused to your baby. This lawsuit may claim that the product was defectively designed, manufactured, or lacked sufficient warnings.
  5. Pursue Compensation: If successful, you may be awarded compensation to cover medical expenses, emotional distress, and other related damages. If the harm resulted in the tragic loss of life, a wrongful death lawsuit could be pursued, potentially providing additional damages for pain and suffering, loss of companionship, and other related costs.

Remember, every situation is unique and legal processes can be complex, so it’s important to consult with a legal professional to understand your best course of action.
