According to a Fox23.com new report, the U.S. Food and Drug Administration has issued another warning for patients and doctors about the new cancer risks associated with breast implants. The warning letter was issued after nearly two dozen adverse incident reports were received by the FDA. The reports stated that people with breast implants are being diagnosed with several types of cancer.
The FDA’s warning letter expressly advised people with breast implants or those who are considering breast implant surgery to consider the risks. The letter states that certain cancers can develop in scar tissue forming around the breast implants. The FDA has received numerous reports concerning squamous cell carcinoma. Squamous cell carcinoma is a potentially lethal and fast-spreading form of skin cancer. The FDA’s warning announcement also reports that the agency has received twelve notifications about various lymphomas connected to breast implants.
The FDA also stated that there is not enough adequate information collected to resolve if breast implants cause these cancers or if certain implant products pose a higher risk than others.
Researchers have made a link between textured implants with anaplastic large-cell lymphoma. It is believed that the reason the cancer incidents with textured implants are higher is because of the implants’ rough exteriors. The rough surface likely causes more inflammation than smooth breast implants.
The confirmed cases of cancer have been linked to all types of implants and those filled with silicone or saline or silicone.
Binita Ashar, with the FDA’s Center for Devices and Radiological Health, said in a press release that the FDA wants to provide clear information to the public as quickly as possible. Ashar said that some breast implant patients reported contracting cancer and having the following symptoms: pain, swelling, skin changes, and lumps. She also affirmed that the reports of breast implant-associated anaplastic large-cell lymphoma were published by the FDA over ten years ago.
The FDA does not recommend patients remove their breast implants because of their warning letter but to monitor their implants for any abnormal changes.
How to File a Product Liability Lawsuit for Cancer Caused by Breast Implants
A product liability lawsuit is a legal claim brought by an individual or group of individuals against a manufacturer, distributor, seller, or any party involved in the chain of distribution of a defective or dangerous product. The claim alleges that the product caused harm or injury to the consumer because of a defect in the design, manufacturing, or marketing of the product.
The purpose of a product liability lawsuit is to hold the responsible party accountable for the harm caused by the defective product and to seek compensation for the damages suffered by the consumer, such as medical expenses, lost wages, pain and suffering, and other related losses.
There are three types of product liability claims:
- Defective design: This claim alleges that the product was designed in a way that made it inherently dangerous, even if it was manufactured and marketed correctly.
- Manufacturing defect: This claim alleges that the product was designed correctly, but an error occurred during the manufacturing process that made the product dangerous.
- Failure to warn or market defect: This claim alleges that the manufacturer or seller failed to provide adequate warnings or instructions about the potential risks and dangers associated with the product, or failed to market the product in a safe and responsible manner.
Product liability laws vary from state to state, but they generally aim to protect consumers from unsafe products and hold manufacturers and other parties accountable for any harm caused by their products. If you believe you have been injured or harmed by a defective product, you should seek the advice of an experienced product liability lawyer who can help you determine whether you have a valid product liability claim and guide you through the legal process.
