On June 22, 2023, Havertys issued a recall for its Concord Dual Power Recliner Chairs Owing due to a defect that can lead to a serious fall risk. In cases where the chair is reclined, the metal power assembly may warp when weight is placed on the backrest as it’s being moved back to an upright position, leading to a potential detachment of the chair back. This could result in a fall hazard for users.

Customers can contact Havertys toll-free at 888-428-3789 from 8 a.m. to 7 p.m. ET, Monday to Saturday. Online support is available at www.Havertys.com by clicking on “Safety & Recall” at the page’s footer, or directly at https://www.havertys.com/safety-and-care for further details.

Why file a product liability lawsuit for injuries caused by this recall?

A product liability lawsuit may be filed in relation to injuries caused by this recall for several reasons:

  1. Compensation for Damages: The main reason to file a product liability lawsuit is to seek compensation for damages. This can include medical expenses, lost wages, and other costs associated with the injury. If the injury resulted in long-term disability or significantly impacted the victim’s quality of life, the compensation could also include pain and suffering.
  2. Accountability: A lawsuit can hold the manufacturer, distributor, or retailer accountable for selling a defective or dangerous product. It can lead to increased scrutiny on their practices and possibly influence them to make changes that prevent future injuries.
  3. Awareness: Such lawsuits can raise awareness about dangerous products or business practices. They can alert other consumers to potential dangers and possibly prevent further injuries.
  4. Precedent Setting: If a lawsuit is successful, it can set a legal precedent that influences future cases. It can provide a legal framework for others who might have been injured by the same or similar products.
  5. Punitive Damages: In some cases, if the court finds that the company was grossly negligent or knew about the defect and did nothing, they may award punitive damages. These are meant to punish the defendant and deter other companies from acting in a similar way.

Remember, pursuing a product liability lawsuit can be a complex process and requires an understanding of the specific laws in your jurisdiction. It’s important to consult with a qualified attorney who specializes in this area to fully understand your rights and the potential outcomes.
