Approximately 12,000 Pella casement windows recalled due to potential risk of injury from detaching sashes.
On December 21, 2023, Pella Corporation announced a recall affecting about 12,000 of its Architect Series casement windows, in addition to approximately 305 units sold in Canada and 10 in Mexico. This recall is driven by a significant safety concern: the window’s sash may separate from the frame and fall, posing a risk of injury to consumers.
Customers in possession of these windows are advised to contact Pella immediately for a complimentary repair by a Pella-certified service technician. The company has established a toll-free line at 888-276-7624 and a dedicated website, www.pella.com, featuring a “Recall Notice” section for more details. Additionally, consumers can check their window’s serial number at www.PellaHingeRecall.expertinquiry.com to confirm if it is included in the recall.
The recall specifically targets Pella’s Architect Series venting wood and aluminum-clad casement windows. Four types of custom-made casement windows are covered: all venting hurricane impact products with side pivot hardware; venting casements with frame heights exceeding 96 inches; venting casements with frame widths wider than 35 inches; and venting casements with frame widths over 29 inches and vent heights over 47 inches, also equipped with side pivot hardware. These windows can be identified by their serial numbers, etched in a lower corner of the glass.
To date, Pella has received one report of a window sash detaching and falling. Fortunately, no injuries have been reported. The affected windows were sold at authorized distributors nationwide, including Pella Window and Door stores, Lowe’s, and other building supply companies from January 2021 to July 2023. Prices ranged from $700 to $10,000 per window. The windows were manufactured in the United States by Pella Corporation, based in Pella, Iowa.
Potential Legal Recourse for Victims
The detachment and falling of window sashes from the recalled Pella Architect Series casement windows pose a significant injury risk to consumers. Victims of such accidents may suffer from various injuries, including bruises, cuts, or more severe harm if struck by the falling sash.
In instances where a consumer is injured by a defective product like these windows, they may have grounds to file a product liability lawsuit. Such a lawsuit aims to hold the manufacturer responsible for selling a product that is unsafe for its intended use. To succeed in a product liability case, the victim must prove that the product had a defect and that this defect directly led to their injury.
The lawsuit process involves several critical steps, including gathering evidence of the defect and the injury, filing the lawsuit, going through the discovery process, and potentially proceeding to a trial. Due to the legal complexities involved in such cases, having an experienced attorney is crucial for navigating the process and ensuring the victim’s rights are adequately represented.
Victims may be entitled to recover damages for medical expenses, pain and suffering, lost wages, and other related costs. In some cases, punitive damages may also be awarded.
