In a recent development that concerns ATV enthusiasts and safety regulators, Polaris Industries Inc. has initiated a recall of its Model Year 2023 RZR PRO XP, PRO XP 4, and Model Year 2024 RZR XP and XP 4 Recreational Off-Road Vehicles (ROVs). The recall, which was officially announced on October 19, 2023, pertains to a critical issue wherein the brake line if improperly routed, can come into contact with the front wheels. This potential contact, if it were to occur, could lead to significant brake line damage, resulting in a total loss of braking ability and subsequently posing a severe crash risk. These accidents can result in serious injuries and deaths.

Polaris has identified approximately 2,500 units under this recall in the United States, with an additional 170 sold in Canada. The recalled vehicles, which were sold between January and August 2023, range in color from black to white and are available in both two and four-seat configurations. As a precautionary measure, the company advises all owners of the said models to stop using the vehicles immediately and to contact their local authorized Polaris dealer to arrange for a complimentary inspection and necessary repairs.

Polaris has confirmed three instances of incorrectly installed brake lines leading to a brake failure. In one concerning case, a vehicle collided with a large rock due to brake loss. These vehicles, manufactured in Mexico and sold at authorized Polaris dealerships nationwide, come with a price tag ranging between $21,000 to $37,000.

For consumers who’ve purchased these vehicles and have subsequently were involved in accidents due to the brake issue, it’s imperative that they understand their legal rights. They may be eligible to file a product liability lawsuit against the manufacturer, seeking damages for any physical injuries, property damage, medical bills, and other associated costs.

The product liability lawsuit process can be complex and legal expertise is necessary to navigate the legal challenges. A claimant must establish that the product was indeed defective and that this defect directly led to their damages. Thus, hiring an experienced attorney is necessary. An experienced attorney from Parker Waichman LLP can guide victims through the intricacies of evidence collection, determining the value of potential damages and the nuances of the lawsuit process.
