San Francisco-based Williams-Sonoma Inc., operating under the brand name Pottery Barn Kids, has issued an urgent recall of approximately 310 units of its Penny Convertible Cribs due to a laceration hazard. The U.S. Consumer Product Safety Commission (CPSC) announced the recall on July 20, 2023, stating that the cribs’ end panel could become loose and expose sharp edges, posing a direct threat to children’s safety.

The recalled product is the Pottery Barn Kids Penny Convertible Crib, identifiable by the model number (SKU) 2850473. The versatile crib, which can be converted into a toddler bed, features a French white color scheme and scalloped detailing. Constructed from radiata pine, the model number can be found on the underside of the crib.

The cribs have been available for purchase online at www.potterybarnkids.com between September 2022 and April 2023, retailing for around $900 each. They were imported from Indonesia by Williams-Sonoma Inc.

As part of the recall measures, consumers are advised to cease using the cribs immediately and contact Pottery Barn Kids to schedule the delivery and installation of new end panels. The company is also offering removal of the old, potentially hazardous end panels, or a full refund as an alternative remedy. Pottery Barn Kids has initiated contact with all known purchasers regarding the recall.

To date, two reports of end panels separating from the crib have been received by the company. Fortunately, no injuries have been reported in relation to these incidents.

Consumers in need of more information can contact Pottery Barn Kids toll-free at 855-801-9300, available from 7 a.m. to midnight ET daily. Alternatively, further details are available online at https://www.potterybarnkids.com/customer-service/recall-penny-crib.html, or by clicking on “safety recalls” at www.potterybarnkids.com.

This recall is part of the CPSC’s “Fast Track Recall” process, aiming to quickly remove hazardous products from the market. Further statements related to the recall may be available from individual Commissioners on the CPSC website.

Seeking Compensation for Child Injuries Due to Pottery Barn Kids’ Faulty Cribs: A Guide for Parents

When a child sustains an injury due to a faulty product, such as the recalled Pottery Barn Kids Penny Convertible Cribs, parents may seek financial compensation by filing a product liability lawsuit. Here’s a step-by-step guide to doing so:

  1. Gather Documentation: First, ensure you have all the necessary documentation. This includes medical records detailing the child’s injuries, pictures of the injuries and the faulty crib, proof of purchase of the crib, and any relevant correspondence with the manufacturer or seller.
  2. Seek Legal Counsel: Consult with an experienced product liability attorney. These legal professionals can guide you through the process, helping you understand your rights and the potential of your case.
  3. Investigate and Prepare the Case: Your lawyer will investigate the case, gathering evidence to support your claim. This can include the aforementioned documentation, expert testimonies regarding the product’s faultiness, and further evidence of negligence or manufacturing defect.
  4. File the Lawsuit: After preparing your case, your lawyer will file the lawsuit in the appropriate court. The lawsuit should detail the nature of the claim, including the specific damage caused by the product, evidence of the defect, and the compensation amount sought.
  5. Negotiation and Settlement or Trial: Following the lawsuit filing, the defendant (in this case, Pottery Barn Kids) may opt to settle the case out of court. If a fair settlement isn’t reached, the case will proceed to trial, where a judge or jury will decide on the outcome.

Please note that the process might vary slightly depending on your jurisdiction and the specifics of your case. Furthermore, there may be time limits (statute of limitations) within which you must file the lawsuit. An attorney can provide guidance on these matters.

Product liability laws are designed to protect consumers from dangerous products, and companies are held to a high standard of care when it comes to ensuring their products are safe for use, especially when children are involved. Parents whose children have been harmed due to faulty products have the right to seek compensation for medical bills, pain and suffering, and other damages.
