The Rise of E-Scooter and E-Bike Injuries: A Concerning Trend in Micromobility Safety

The U.S. Consumer Product Safety Commission's report highlights a significant rise in injuries related to micromobility devices like e-scooters, e-bikes, and hoverboards. In 2022, e-scooter injuries increased by 22%, and e-bike injuries saw a notable rise, with 46% occurring in that year alone. Hoverboard injuries decreased by 26%. Children and non-Hispanic Black consumers were disproportionately affected. The report also notes fire hazards associated with these devices, resulting in 19 fatalities from 2021 to 2022. Legal recourse for victims includes potential product liability lawsuits, with specialized legal assistance recommended.

The revolution in personal transportation options such as e-scooters, hoverboards, and e-bikes has brought with it a surge in related injuries. The U.S. Consumer Product Safety Commission (CPSC), an agency established by Congress in 1973 to safeguard the American populace against risks associated with consumer products, has unveiled startling figures in its latest report.

Titled “Micromobility Products-Related Deaths, Injuries, and Hazard Patterns,” the CPSC’s report delves into the alarming increase in injuries linked to these contemporary modes of transport. The 2022 statistics reveal a jump of nearly 21% from the previous year. E-scooters alone accounted for a 22% year-over-year escalation in injuries. E-bike injuries from the six-year span of 2017 to 2022 had a significant 46% of them taking place in 2022. In contrast, hoverboard-related mishaps saw a decrease of 26%.

A further deep dive into the report’s data showed that a total of 233 deaths from 2017 to 2022 could be attributed to micromobility devices, though this tally remains a work in progress. Children, especially those 14 years or younger, were disproportionately affected, constituting 36% of the injury cases. There’s also a racial disparity in the numbers: non-Hispanic Black consumers made up 29% of the injuries, significantly surpassing their proportion in the U.S. population.

The types of injuries varied. According to the CPSC’s report, there were 360,800 emergency department visits between 2017 and 2022 connected to micromobility devices. Bone fractures were the most common injuries, with contusions and abrasions following closely. Predominantly, injuries occurred in the upper and lower limbs and the head and neck region. The calendar also played a role; e-scooter and e-bike injuries largely occurred between May and October, while December and January were “high risk” for hoverboard accidents.

Perhaps more concerning is the fire hazard these devices pose. From 2021 to late 2022, fires linked to micromobility devices accounted for 19 fatalities. In response, the CPSC, in December 2022, addressed manufacturers, importers, and distributors of these products, emphasizing adherence to safety standards.

Legal Pathways for Victims

With the rising tide of micromobility-related injuries, victims may be wondering about their legal recourse. The significant increase in these injuries highlights a potential area of negligence on the part of manufacturers, retailers, or distributors. Those affected by such injuries could consider filing a product liability lawsuit. Through such litigation, victims might be able to recover damages for medical bills, pain and suffering, lost wages, or even punitive damages in cases of extreme negligence.

However, the legal maze isn’t straightforward. Gathering evidence, understanding the nuances of product liability laws, potentially battling against corporate legal teams, and sometimes enduring the intricacies of a court trial can be daunting. This makes hiring a specialized attorney not just advisable but essential. They can provide guidance at every stage, ensuring that victims’ rights are protected and that they secure the compensation they rightly deserve.
