Tennessee’s Attorney General, Jonathan Skrmetti, has launched a legal assault on more than two dozen chemical manufacturing corporations, including industry giants (https://www.3m.com/) and (https://www.dupont.com/). The legal challenge accuses these companies of knowingly suppressing the dangers posed by specific persistent chemicals to both public health and the environment, all while amassing substantial profits from their sales.

The contentious chemicals are often found in a specialized foam, referred to as aqueous film-forming foam (AFFF), which is employed during fire drills and real emergencies at military bases, airports, and other key sites. According to the lawsuit, initiated in Davidson County Circuit Court in May, these chemicals have found their way into various water sources – from surface and groundwater to drinking water – and have exceeded safety thresholds throughout Tennessee.

Tennessee’s lawsuit aims to secure various forms of compensation, including financial restitution for damage and clean-up expenses related to the persistent chemical contamination. The lawsuit alleges that despite being alerted to these risks by their in-house scientists as early as the 1970s, the defendant companies chose to dismiss them. In addition, they are accused of deliberately hindering research that illuminated PFAS’s adverse effects, and failing to disclose internal findings attesting to the chemical’s toxicity. The lawsuit also suggests that some firms unlawfully transferred assets to evade liability for PFAS releases.

“Despite being fully aware of the associated risks, manufacturers continued to produce and derive profits from these chemicals. They will be held accountable,” Skrmetti stated in a press release. “We will fight for comprehensive compensation from each defendant to ensure we can remediate our environment and mitigate the harms caused by PFAS.”

The Tennessee lawsuit adds to a mounting number of federal lawsuits initiated by firefighters and residents, who allege harm from the presence of PFAS in AFFF.

The lawsuit asserts, “Those who profited from causing this problem, and not the affected citizens of Tennessee, must bear the financial burden of addressing PFAS contamination throughout the state.”
