Who Is Responsible After a Rideshare Accident?
Ridesharing companies provide a hassle-free, convenient transportation option for millions of Americans. With just the touch of a button, a rideshare user can locate a ride and be on their way. However, when it comes to recovering compensation after an accident involving a rideshare vehicle, things quickly become complicated.
Rideshare companies are required to purchase insurance policies to compensate an accident victim for their injuries. Policy availability will depend on the rideshare driver’s status at the time of a collision. When a ridesharing accident occurs, it’s possible to seek compensation from any party that contributed to the crash, such as the negligent motorist of another vehicle, a motorcyclist, and more.
Accepting a Ride Request
A rideshare company’s comprehensive insurance policy is available if the rideshare driver has accepted a ride request or is transporting a passenger. Rideshare companies are required to provide coverage of over a million dollars for property damage, personal injury, and death.
This coverage can apply to any party that’s involved in a rideshare accident, including:
- The passenger in a rideshare vehicle
- Other drivers
- Passengers in another vehicle
- Bicyclists
- Pedestrians
If the rideshare driver is at fault, you’ll need to prove this. If the at-fault driver’s insurance policy provides coverage, that coverage applies first. It may also be necessary to file an insurance claim with your auto insurance provider if you live in a no-fault state.
The rideshare company’s insurance coverage is there to make up the difference, considering a personal car insurance policy typically only covers a small portion of an accident victim’s damages.
Rideshare Driver is Logged into the App But Hasn’t Accepted a Ride
If a rideshare driver is actively using the app but has yet to accept a ride, a limited rideshare insurance policy will become active.
This insurance will cover:
- $25,000 per accident in property damage
- $50,000 per individual in bodily injury coverage
- $100,000 per collision in bodily injury coverage
Like with the rideshare company’s other insurance coverage, the company will only cover accident-related losses if the other available policies cannot completely cover damages.
